General terms of use

1. Validity

The operator of the voucher store is (Profile not complete) (hereinafter referred to as the "Service Provider").

All deliveries and services from the service provider and the associated online orders are subject to these General Terms and Conditions (GTC). Deviating and/or supplementary agreements must be made in writing and require the express consent of the service provider.

The online solution (software) is provided by indual GmbH, 3900 Brig, Switzerland (hereinafter referred to as "indual").

These GTC govern the legal relationship between the service provider and the voucher purchaser.

2. Purchase of gift vouchers

It is possible to purchase gift vouchers on the website or on this online portal (in PDF format or by printing on a gift card, depending on the option selected).

The services of the selected gift voucher are described in the shopping cart and printed on the voucher.

The validity of a gift voucher may vary depending on the type of voucher. The exact validity date and period are noted on the gift voucher. After the expiry date, the service provider is no longer obliged to accept the gift voucher.

The services listed in the gift voucher can only be provided and guaranteed if the gift voucher has been paid for and a corresponding and timely reservation has been made with the service provider.

Each gift voucher is given a unique voucher number (8 characters and digits) when it is purchased and can therefore always be identified. A gift voucher can be blocked at any time in the event of fraud.

Gift vouchers offered online may have a maximum value of CHF 3'000.

3. Payment & delivery

A gift voucher is only valid if payment has been received in full.

If payment is made by credit card, the amount will be charged to the credit card immediately.

When paying by invoice, the amount is due immediately and can be transferred by bank within 20 days. After the 21st day, the service provider is entitled to charge reminder fees of at least CHF 20.

In the shopping cart, the gift voucher purchaser is redirected to an external payment service provider, unless the gift voucher purchaser has selected payment by invoice as the payment method.

The gift voucher will either be delivered directly as a PDF file or sent by post within 5 working days. The gift voucher purchaser can choose the type of shipping independently (the service provider can freely define the various shipping options).

Complaints regarding the scope of delivery, material defects, incorrect deliveries and deviations in quantity must be reported by the gift voucher purchaser immediately, but at the latest within one week of receipt, insofar as these can be determined by reasonable inspection.

4. Redemption of gift vouchers

A gift voucher can only be redeemed if payment has been received in full and the voucher is covered accordingly.

Each gift voucher can only be redeemed once. There is no claim for fulfillment and/or delivery or compensation against the service provider or against indual if someone tries to redeem several gift vouchers with the same code.

Should further gift vouchers with the same code appear, this constitutes misuse and will result in criminal prosecution.

The gift vouchers are transferable to other persons. They can be redeemed by any person.

To redeem the gift voucher, the gift voucher holder undertakes to contact the service provider in good time.

5. Abuse

A gift voucher code with a security key is printed on the gift voucher to prevent misuse.

Liability for incorrect information is excluded by both the service provider and indual.

Should the service provider have to close or give up for any reason, all gift vouchers will expire without compensation. This is also the case if the service provider demonstrably changes ownership.

6. Exchange / loss

The gift voucher cannot be exchanged for other gift vouchers.

It is not possible to return gift vouchers for a cash value payment.

7. Right of withdrawal

There is no right of withdrawal for gift vouchers that are paid for online and printed out.

Gift vouchers paid by invoice can be revoked within 24 hours. For this purpose, the gift voucher purchaser is obliged to contact the service provider in writing within 24 hours of purchase.

8. Customer data

The service provider is entitled to collect, store and process the customer's personal data required in the context of the business relationship, taking into account the corresponding duty of care in handling sensitive customer data.

9. Place of jurisdiction, severability clause

The place of performance and jurisdiction is Brig, Switzerland.

Should individual provisions of these General Terms and Conditions be wholly or partially invalid or lose their legal validity at a later date, this shall not affect the validity of the remaining General Terms and Conditions. The invalid provision shall be replaced by the statutory provisions. The same applies if there is an unforeseen gap in the General Terms and Conditions.
